When Does a Pet Owner Violate the Law?

Starting from June 1, 2027, the registration of cats, dogs, and ferrets is expected to become mandatory. At the same time, the state intends to create a unified pet register, in which pet owners will be required to register all pets kept at home.

Since there has been no national register so far and not all municipalities have joined existing systems, the overview of pets is incomplete and the performance of supervisory duties has been difficult. Time and again, we see media reports about the growing number of stray cats and dogs or large-scale breeding facilities where animals are sick and suffering.

What does the law say?

Pet owners may not be aware that the Animal Protection Act and the Veterinary Act set out clear obligations for them. To avoid violations, it’s worth revisiting some of these responsibilities as a reminder.

  1. Make sure your pet is properly fed and always has access to fresh water. Pet owners are obliged to provide their animals with the necessary food and drinking water. If your pet is malnourished, an animal welfare officer may soon be informed and come to inspect your pet’s condition.
  2. Ensure that your pet has enough space and opportunities to move. As of today, keeping pets on a chain is not yet prohibited, but the legislation is moving in that direction. As a pet owner, make sure that if you still keep your dog chained or in a cage, the animal can move freely. Check that the chain used meets the legal requirements. Even better, if you’re worried your dog might wander off, build an outdoor enclosure where you can occasionally leave them safely. The enclosure should provide shelter (the best option is an insulated and waterproof doghouse) and constant access to drinking water. If your pet spends time in an enclosure, you must also allow them to move freely at other times. Dogs need daily walks to live a full and healthy life. Poor living conditions can easily lead to a visit from an inspector. Care for your pet as you would care for yourself.
  3. Visit a veterinarian regularly with your pet. Familiarize yourself with the necessary procedures (parasite control, vaccinations). If it turns out that your pet’s health is poor and the required care has not been provided, it is very likely that the supervisory authority will take an interest in your case.
  4. Make sure your pet does not end up on the street. Stray animals are a serious problem, and the consequences can be severe for both the owner and the animal. Remember that as the pet owner, you are responsible for your animal. If your dog attacks someone, you are liable for the resulting damage. The owner is also responsible for the fact that the animal got loose in the first place.
  5. Microchip your pet and register them as early as possible. This helps ensure a quick return home if your pet goes missing. Even though microchipping and registration are not yet mandatory, that doesn’t mean you should ignore it. It’s an essential measure. Pet owners must ensure that their animals do not become strays. Microchipping makes it easier to identify the owners of lost pets.

Can a lawyer help pet owners?

Animal welfare is now recognized as a legal value protected by law. A pet is not just a movable object but a living being that needs as much care and attention as a human. Before deciding to get a pet, make sure you understand all your legal responsibilities. Don’t be indifferent. If an animal welfare officer knocks on your door, it’s worth reflecting on how your pet has been treated so far. The officer is simply doing their job – ensuring that the animal is well cared for.

Stay informed about your responsibilities as a pet owner. If your pet is not yet microchipped, it’s advisable to do so before it becomes mandatory. Microchipping is essential to ensure better monitoring of animal welfare and to reduce the already large number of stray animals.

At the same time, it’s possible that a pet owner may be treated unfairly. You may know that you’ve done everything to ensure your pet’s well-being, yet someone might claim otherwise. If a dispute regarding your pet becomes overwhelming, it’s wise to contact a competent lawyer. Both the pet’s and the owner’s rights deserve protection.
